EXCLUSION OF LIABILITY, RELEASE, ASSUMPTION OF RISK, WARRANY AND INDEMNITY FORM

1. TADACT is the organiser of a "Walk a Loop", being held on [01/12/12] around Lake Burley Griffin in the Australian Capital Territory ("the Event"). 
2. In exchange for being able to participate in the Event, the Participant acknowledges, agrees and accepts that:
   1. there are inherent risks associated with participating in the Event, including the risk that the Participant may be injured or otherwise suffer loss or harm, including as a result of the Participant's own actions or physical condition; harmful or violent acts (whether or not intentional or inadvertent) committed by other persons participating in or attending the Event or otherwise; and the failure or unsuitability of facilities to ensure the safety of persons or property during the Event;
   2. participation in the Event may involve a risk of serious injury or even death from various causes including: over exertion, dehydration, cardiac arrest, accidents with other participants, spectators and road users;
   3. the Participant participates in the Event at his or her own risk;
   4. TADACT does not warrant or make any representation as to the suitability, ability or experience of other Participants and TADACT is not responsible for the conduct of Participants;
   5. entries are non-transferable and this Release must be signed otherwise TADACT will not accept the Participant's entry.
3. To the maximum extent permitted by law, the Participant agrees to release TADACT, the management, organisers, promoters, landowners and/or occupiers of the Location and their respective representatives, officers, employees and agents (collectively the "Associated Entities") from any and all liability for the Participant's death and/or personal injury, whether physical or psychological or damage or theft of the ParticipantŐs property ("Harm") howsoever arising as a result of or in connection with the Participant's participation in or attendance at the Event (including without limitation, as a result of any negligence on the part of TADACT or the Associated Entities or any of them).
4. The Participant acknowledges and accepts that, to the maximum extent permitted by law, TADACT and the Associated Entities do not make or give any warranty, implied or express, that any services provided at the Event will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied.
5. The Participant warrants that the Participant:
   1. is in good health and does not suffer from any medical conditions or disability, illness or injury which would render the ParticipantŐs attendance or participation in the Event hazardous to the Participant;
   2. will withdraw from the Event in the event that he or she becomes aware of any medical condition or impairment, or is otherwise sick or injured prior to the Event;
   3. will abide by the Rules and Conditions established by TADACT in relation to the Event.
6. The Participant hereby indemnifies and keeps indemnified, TADACT and the Associated Entities for all liability, loss damage, costs (including legal fees on an indemnity basis) and expenses of any nature whatsoever and howsoever caused (whether by negligence, breach of contract or otherwise) which TADACT or the Associated Entities may incur or sustain, including but not limited to third party claims and any liability for Harm, arising out of the ParticipantŐs participation in the Event or breach of this Release and Indemnity.
7. TADACT and its agents reserve the right to refuse to permit the Participant to participate in or attend the Event, in their absolute discretion.
8. The Participant agrees to TADACT entering his or her personal details on the entry form into a database which will be used for the administration of the Event and which may be used for future marketing and promotion of the Event.
9. The Participant agrees to TADACT sending the Participant any promotional material relating to their organisation or their fundraising efforts.
10. The Participant consents to the publication of his or her name and image without payment or compensation.
